三 | 与会的俱乐部投资人和总经理明确提出,要积极推进设置工资帽、鼓励各俱乐部自主培养年轻球员、推出球员标准合同、扩大和规范球员交流方式等工作,并为此成立了工作小组。在2020-2021赛季之前的三个赛季,CBA公司一直在为工资帽的推出做准备,其中标准合同的使用是重要一环。2018-2019赛季,CBA开始测试标准合同,2019-2020赛季全面试行。在此基础上,包含工资帽相关规则的《2020-2021赛季CBA联赛球员注册、报名管理规定》得以在2020-2021赛季前推出并实施。“CBA公司希望通过工资帽制度的实施,规范各CBA俱乐部的运动员薪酬,引导各俱乐部健康可持续发展,逐步管理好运动员和身边人的预期。”该负责人表示,联赛是一个共生关系,多方利益需要逐步平衡。如果球员在联赛中表现出色,除了工资收入之外,还能从商业赞助等方面获得收益。联赛机构同时希望俱乐部除了靠资金投入之外,也通过俱乐部文化建设、硬软件环境等吸引球员长期效力。“CBA联赛不仅仅是一个商业联赛,它承担着推动篮球运动在中国的发展,以及为国家队输送人才等重要使命。绝大部分球员最终也会从一个健康有序发展的CBA联赛中受益。”CBA公司表示,工资帽制度的实施,在联赛整体发展、俱乐部建设、运动员职业生涯发展、媒体及球迷几个层面都带来了积极影响。CBA联赛始终将“做最具价值的体育联赛”作为使命,一个规则统一的竞争环境是CBA联赛做大、做强的基础之一。工资帽制度的适时推出,在一定程度上增强了俱乐部间的信任度,同时俱乐部薪酬及财务管理水平在一定程度上获得了规范和优化。该负责人表示,工资帽制度的实施,有效遏制了国内运动员薪资增长过快的趋势,规范和管控了各方预期,防范风险的发生。运动员也通过工资帽制度了解国家相关财务、税务知识,有助于让球员们认识到遵守相关财务、税务规定,配合工资帽制度实施的重要性和必要性。他表示,自从工资帽制度推出以来,社会各界、媒体和球迷通过官方渠道了解了工资帽相关制度,各方都认为这是一个联赛健康发展的基础,是件好事。

四 | 大家也希望这项制度得到长期坚持,并提出了很多有益的建议和意见。“我们也将根据CBA联赛实际,对工资帽制度不断进行优化。工资帽制度的建立也是为了促进联赛良性发展,规范俱乐部行为,避免无序竞争。

五 | ”CBA联赛近两个赛季单支球队国内球员整体基本工资帽下限呈连降趋势。对此该负责人表示,下调整体工资帽下限,是考虑到目前的市场环境和俱乐部实际运营的情况。但这只是针对俱乐部整体工资帽下限的下调,俱乐部整体工资帽上限保持不变,主要是考虑到合同的延续性以及保持工资投入的基本稳定。辽宁男篮俱乐部始终享有郭艾伦顶薪独家签约权郭艾伦日前通过经纪团队向辽宁队提出了转会申请,引发外界关注。

六 | 根据《管理规定》,俱乐部在相关聘用合同到期后继续拥有该球员顶薪合同(D类)独家签约权。符合条件的俱乐部,须在不迟于球员原合同到期前30日,向该球员提供D类合同并按规定书面通知对方;如因球员原因拒绝续约的,俱乐部仍保留D类合同独家签约权直至俱乐部放弃或转让此权利。

七 | CBA公司有关负责人表示,这涉及两种情况:第一是俱乐部提供顶薪合同,球员未签订;第二是双方签订了顶薪合同。

八 | 第一种情况,按照目前的规则,俱乐部在规定时间内,向球员提出顶薪续约后,即享有独家签约权,但并不代表球员只能和原俱乐部签约。原俱乐部可与CBA联赛的其他俱乐部交易,转让D类独家签约权。

九 | 这已有先例,如上赛季的王哲林,福建俱乐部在申请D类独家签约权后转让至上海俱乐部。设置D类顶薪合同的初衷也是维护联赛可持续发展,增加比赛的观赏性。

十 | 在第二种情况下,双方签订了顶薪合同,运动员在合同履行一年后可以转会。郭艾伦目前面临的处境,让人联想到上赛季CBA开始前的另一位中国男篮国手周琦。

十一 | 当时他未接受新疆俱乐部提供的顶薪合同,退出上赛季CBA联赛,加盟澳大利亚篮球联赛东南墨尔本凤凰队。该负责人解释说,郭艾伦和周琦的情况差不多,都属于合同到期,原俱乐部享有顶薪独家签约权,直至俱乐部放弃或转让该权利;如果郭艾伦选择效仿周琦前往海外联赛效力,则原俱乐部无权干涉,待其返回CBA联赛时,辽宁俱乐部仍享有其CBA联赛顶薪独家签约权。“CBA联赛也欢迎、鼓励和支持国内球员去海外的高水平联赛打球,进一步提高自身的竞技水平,最终能够代表国家队在国际大赛的赛场上打出好成绩。”该负责人说。

十二 | 严禁各种形式“阴阳合同”对于现行工资帽制度下有可能出现的“阴阳合同”,该负责人表示,球员与俱乐部签署的《聘用合同》中已明确,《聘用合同》是双方明确权利义务的唯一合同,在球员注册时也须提供球员及俱乐部签订的《诚信承诺书》。

十三 | 同时,《中国男子篮球职业联赛纪律准则》中设有单独章节,明确“违反诚信原则的处罚”,其中就包括签订“阴阳合同”的处罚。对球员的处罚包括警告、罚款、停赛若干场直至上报暂停(停止)或取消注册资格1到2年的处罚;对俱乐部的处罚包括警告、取消当赛季的评优资格、收回已获得相关奖项、暂停国内球员交易、暂停注册外籍球员、核减联赛经费、罚款等;对违规的俱乐部负责人、相关人员也有不同程度的处罚。“CBA联赛严禁各种形式的‘阴阳合同’,纪律准则也有明确及严厉的处罚措施。”该负责人说,“出现‘阴阳合同’一定是俱乐部和球员双方的责任。

十四 | 根据公司现有规定,在发现相关线索后,将会按照相关权限和流程进行调查、取证,查实后将根据纪律准则进行处罚。”在保护球员权益方面,CBA公司一直在做积极努力和尝试。从2019-2020赛季起推出的CBA球员合同保障险,保障球员在因伤病无法参赛期间,薪酬发放能够得到保障,同时也减轻了俱乐部的经营压力。此外,球员“康复险”也在积极推进中。
